Public Notice and Participation in the Certificate of Authority Application Process
The High Voltage Transmission Act directs, at 17 O.S. § 851(D)(1) and (2), that when an application is filed, there is to be public notice in various forms and to various stakeholders, which includes, but is not limited to, the surface landowners with land located within the transmission facility route or routes.
Likewise, within the High Voltage Transmission Facility Act, there is also a requirement that the following opportunities for public participation be made available:
- Public Meetings — The developer is required by law to hold county public meetings as part of the CoA proceeding (17 O.S. § 851(D)(3)).
- Public Comment — Any member of the public may submit written comments in the case at any time or make in-person comments at the Hearing on the Merits held before the OCC. Such hearing date will be available on the Commission website once established pursuant to Commission rules.
