Per Title 75 of the Oklahoma Statutes (O.S.) § 305, any person may petition the Oklahoma Health Care Authority (OHCA) for adoption, amendment, or repeal (revocation) of any rule of the OHCA. Upon receipt of the petition, the OHCA will initiate a study of the requested change. If the OHCA formally acts upon the petition, the petitioner will be advised of the action in writing. If the OHCA does not initiate rulemaking proceedings within thirty (30) calendar days of the petition's submission, the petitioner shall be deemed to have been denied.
