APA WF # 26-03 - H.R. 1 Alien Eligibility
These policy changes are currently approved as emergency rules and are being proposed as permanent rules.
The proposed policy revisions align with eligibility changes included in H.R. 1, also referred to as the Working Families Tax Cut legislation. Beginning October 1, 2026, federal financial participation (FFP) is only available for Medicaid benefits furnished to United States citizens, lawful permanent residents (LPRs), certain Cuban/Haitian entrants, and citizens of the Freely Associated States covered under the Compact of Free Association (COFA). Most other non-citizens will no longer qualify for full-scope coverage and will be limited to Emergency Medical Assistance. The proposed revisions also include clean-up language and minor technical corrections.
Pursuant to 75 O.S. § 303(D), a rule impact statement will be posted here beginning October 16, 2026. Individuals may also request a copy using the comment box, and the statement will be provided on October 16, 2026.
