OHCA State Plan Amendment Rate Committee (SPARC)

Background

Codified at 42 U.S.C. §§ 1396a(a)(13)(A), 1396a(a)(30)(A), and 1396b; Part 447 of Title 42 of the Code of Federal Regulations; and Oklahoma’s Central Purchasing Act, 74 O.S. § 85.7.

Purpose

The Advisory Committee on Rates serves the rate setting process by conducting public hearings at which the public, vendors, and Oklahoma Health Care Authority staff are afforded the opportunity to provide testimony and documented evidence in support of rate recommendations.

The State Plan Rate Committee only operate to make recommendations for changes to rates and/or methodology that necessitate a State Plan Amendment.

Committee Membership

The Rates Committee is comprised of administrative and executive level staff designated by the Chief Executive Officer for the Oklahoma Health Care Authority.

Voting

A majority of the member of the State Plan Rates Committee (SPARC) (half of the members present) shall constitute a quorum for transaction of business for taking any official action. Official action of the SPARC committee must have a favorable vote by a majority of the members present.
