APA WF # 24-18 Third Party Liability for School Based Services

Third Party Liability for School Based Services — The OHCA will seek approval of an emergency rule revision to add an exception to the Third-Party Liability (TPL) requirement for services rendered in a school setting for certain populations. For students with an Individualized Education Program (IEP) or an Individual Family Service Plan (IFSP), Medicaid shall be the payor of first resort. Currently, IEP & IFSP services are not exempt from TPL.

Considering the amount of children that have IEPs, I think it’s great to have the option. I believe it will cut out delays and allow providers to timely perform services. There is a concern with MCO payments and the delay since the switch.
