APA WF# 24-06 Living Choice Timeline Clarification

These rule changes are currently in effect as Emergency Rules and must be promulgated as Permanent Rules.

These revisions update Living Choice policy to align with the Consolidated Appropriations Act (CAA) of 2021, which changed Section 2403 of the Affordable Care Act (ACA). The policy change clarifies that time a member spends within a skilled nursing facility will be considered when assessing timeline requirements for applications to the Living Choice program.
