OK SPA 21-0043 Non-Emergency Transportation (NEMT) Provider-Driver Requirements
The proposed Title XIX state plan amendment comes into compliance with federal regulation which requires the State Plan to provide the Agency’s current mechanism that ensures any NEMT provider or individual driver meet certain minimum requirements. The State Plan will include the Agency’s current process for verifying that the State’s broker of NEMT services ensures compliance with all driver requirements inclusive of the following minimum requirements from federal regulation: ensuring that drivers are not excluded from participation in any federal health care program, ensuring that drivers have valid driver's licenses, requiring providers to have a process in place to address violations of state law, and requiring providers to have in place a process to disclose to the state Medicaid program the driving history of each individual driver employed inclusive of any traffic violations.
