As previously shared, House Bill 4454 creates clarity around the requirements for OMMA-licensed processors when packaging and labeling medical marijuana products.
The new law gives specific instructions to the industry regarding product shapes, styles and packaging characteristics that are considered appealing to children, including cartoons, toys, animals or likeness to commercially available candy. Applicable statutory language found in 63 O.S. Section 423 (C)(7) is quoted below:
7. Packages of edible medical marijuana products processed, produced, packaged, or transferred by licensed medical marijuana processors shall clearly indicate the number of servings of tetrahydrocannabinol in each package and the amount of tetrahydrocannabinol in each individual serving. Drinks or beverages shall clearly indicate on the container the number of servings in each drink or beverage and the amount of tetrahydrocannabinol in each individual serving. Edible medical marijuana products shall not:
a. be attractive to children. As used in this subparagraph, "attractive to children" means the use of any image or words designed or likely to appeal to persons younger than eighteen (18) years of age including, but not limited to, cartoons, toys, animals, food, or depictions of persons younger than eighteen (18) years of age, any other likeness to images, characters, or phrases that are popularly used to advertise to persons younger than eighteen (18) years of age, or any reasonable likeness to commercially available candy,
b. be manufactured in the shape of humans, cartoons, or animals, or
c. be manufactured in a form that bears any reasonable resemblance to products available for consumption as commercially available candy.
Following questions from licensed operators regarding the upcoming changes and impacts, OMMA has further clarified HB 4454 requirements below:
Processors:
- Any products produced, processed, packaged, or transferred to a dispensary on or after Nov. 1 must bear the new labeling requirements and meet all requirements of HB 4454.
- Beginning on Nov. 1, the transfer of any products to a dispensary that are not in compliance with HB 4454’s new requirements is prohibited.
Dispensaries:
- A dispensary may retain, display, and/or sell products remaining in its inventory on or after Oct. 31 that comply with pre-HB 4454 labeling requirements.
- As the state’s medical marijuana regulatory authority, OMMA will begin enforcing the new law on Nov. 1, 2026. The agency’s compliance inspection team is undergoing thorough training ahead of the effective date to support consistent, fair enforcement statewide.
