Dispensing Permits

Restriction on Dispensing Drugs- Title 510 Subchapter 3

Requirements

Physicians who wish to dispense medication out of their office, must have a Dispensing Permit for each location in which they dispense.

Those who do dispense must follow the below:

  • Dispensed medication shall be properly packaged and labled;
  • Scheduled medication must be reported to the Prescription Monitoring Program (PMP);
  • Dispensing records must be kept for a period of at least five (5) years; and
  • Dispensers must annually register each location with OSBOE and obtain dispensing permits for each.

Permits are not required if professional samples are being distributed and documented in the patient's chart.

Physician's with dispensing permits are subject to audit by the Educational Audit team at OSBOE.

All permits expire June 30 of each year, no matter the issue date, and must be renewed before July 1 to remain active.

Obtaining a Permit

To obtain the dispensing permit(s) the physician will first login to the licensee portal and ensure all locations being requested are entered in the "Employment History" page.

Once employment records are accurate, the physician will select "Dispensing Permit" from the navigation menu and follow the process for each location needed.  Each application will be submitted separately with the applicable fee.

Following submittal, OSBOE will review the permit application and process.  If approved, the licensee will receive an email informing them of the decision.  They can log back in and download the permit for each location and print to display.

NOTE: Dispensing Permits can no longer be purchased during the annual renewal process.  The renewal must be submitted first, and then requests for dispensing permits will be submitted separately following.
