Exception Requests

This page provides guidance for osteopathic physicians who wish to request an exception to the supervision limits set forth in Oklahoma Administrative Code 510:10-4-3.

When is an exception request required?

An exception request is required when a supervising osteopathic physician:

  • Asks to supervise more than six (6) mid-level practitioners.
  • Asks to forego the monthly practice location visit.
  • Asks to supervise an immediate family member.
  • Asks to review less than fifteen percent (15%) of patient charts monthly.
  • Asks to charge a fee for supervising an ARPN at a rate higher than $300 per hour (See Policy OSBOE-P008).

How is an exception request submitted?

If requesting an increase to the six (6) mid-level practitioners allowed, prepare and submit the following information as outlined in OSBOE-P003 to support@osboe.ok.gov.

  1. General Section of Packet
  2. Current Mid-Level Section of Packet
  3. Proposed Mid-Level Section of Packet

If not requesting an increase, prepare and submit the following information as outlined in OSBOE-P003 to support@osboe.ok.gov.

  1. General Section of Packet
  2. Detailed Explanation of the Exception Request
  3. Any Relevant Documentation

What are the steps following submittal?

Once an exception request has been received:

  1. Board staff will respond with receipt of the request and inform the requestor they will be added to the Board's next regularly scheduled meeting. Note: If this is time sensitive request, please indicate so.  The Executive Director may temporarily approve exceptions between meetings on a case-by-case basis.
  2. Board staff will review the submission and reach out to discuss any additional information needed or questions they have.
  3. Requestor will appear at the Pre-Hearing Conference roughly one (1) month before the Board appearance to prepare for their request to be heard before the Board.
  4. Requestor will appear in person or via teleconferencing at the Board meeting and present their request.  Board may approve, deny, modify, or table the request.
  5. Following the Board meeting, Board staff will be in touch with an Order based upon the Board's decision.
