Annual Disclosure of Federal Funds

This report is produced pursuant to the requirements of 62 O.S. § 34.42.1 (effective November 1, 2019).

The Oklahoma State Legislature has designated the Secretary of the State Election Board in state law as the "chief state election official responsible for coordination of state responsibilities... under the Help America Vote Act of 2002." (See 26 O.S. § 2-107.) 

The Oklahoma State Legislature also created the "State Election Board Help America Vote Act Revolving Fund" and authorized the State Election Board to accept federal funds under the Help America Vote Act in state law. (See 26 O.S. § 3-107.2.) On multiple occasions, the Oklahoma Legislature has appropriated state matching funds for Help America Vote Act grants.

The Oklahoma State Election Board does not regularly receive Federal funding. However, the State Election Board has periodically received Federal grants under the Help America Vote Act (HAVA) of 2002. The following State Election Board accounts include the funding from Federal grants provided to the State of Oklahoma.

HAVA Title II, Section 251 Funds (CFDA 90.401)
As part of the Help America Vote (HAVA) of 2002, the U.S. Congress has periodically provided Federal grants to the states to offset the costs of complying with the requirements of HAVA.  Because Oklahoma has certified that it has fully implemented the requirements of HAVA, the remaining HAVA grant funds can be expended to improve the administration of elections for Federal office.
  • The balance of the fund as of December 31, 2023 is $1,908,070.36.
  • Interest earned on these Federal grants is required to be deposited into the fund.
  • Each grant required a one-time 5% state match.
  • Funds from these Federal grants were required to be expended on the implementation of the requirements of HAVA. Because HAVA has been fully implemented, remaining funds can be expended for the purpose of improving the administration of elections for Federal office.
  • The State Election Board must provide a drug-free workplace as a condition of receiving these Federal grants.

2018 and 2020 HAVA Security Funds (CFDA 90.404)

HAVA Election Security Funds were appropriated in 2018 and 2020.  The two HAVA Election Security Fund appropriations, authorized under Title I Section 101 of the Help America Vote Act (HAVA) of 2002, mark the first new appropriations for HAVA grants since FY2010. This funding provides states with additional resources to secure and improve election systems.

The Consolidated Appropriations Act of 2018 included $380 million in grants, made available to states to improve the administration of elections for Federal office, including to enhance technology and make certain election security improvements. 

The Consolidated Appropriations Act of 2020 authorized an additional $425 million in new Help America Vote Act (HAVA) funds to improve the administration of elections for Federal office, including to enhance technology and make certain election security improvements.

  • Oklahoma’s share of the 2018 Federal grant was $5,196,017.
  • The grant required a one-time state match of $259,801 (5% of the grant amount). The state match was funded with filing fees from the State Election Board Revolving Fund.
  • Oklahoma’s share of the 2020 Federal grant was $5,840,818.
  • The grant required a one-time state match of $1,168,164 (5% of the grant amount). The state match was funded with a state appropriation of $1,164,069 and $4,095 from the State Election Board Revolving Fund.
  • The balance of the fund (combined 2018 and 2020 grants) as of December 31, 2023 is $8,712,769.40.
  • Interest earned on the Federal grant money is required to be deposited into the fund.
  • The Federal grants are required to be expended for the purpose of improving the administration of elections for Federal office, including to enhance technology and make certain election security improvements.
  • The State Election Board must provide a drug-free workplace as a condition of receiving the Federal grants.

2020 Coronavirus Aid, Relief, and Economic Security Act (CARES Act) (CFDA 90.404)

On March 27, 2020, the Coronavirus Aid, Relief, and Economic Security Act (CARES Act) was signed into law. The Act included $400 million in new Help America Vote Act (HAVA) emergency funds, made available to states to prevent, prepare for, and respond to the coronavirus for the 2020 federal election cycle. This supplemental appropriation funding, distributed by the U.S. Election Assistance Commission (EAC), provided states with additional resources to protect the 2020 elections from the effects of COVID-19.

  • Oklahoma’s share of the 2020 CARES Act grant was $5,460,972; however, we only requested a total of $2,730,486.
  • The grant required a 20% state match of $546,097 (20% of the amount received). The state match was funded with a one-time state appropriation of $206,000 and $340,097 from the State Election Board Revolving Fund.
  • Interest earned on the Federal grant money is required to be deposited into the fund.
  • The State Election Board spent a total of $1,226,866.49 as of December 31, 2020 and will return the remaining grant amount of $1,503,619.51 plus interest earned.
  • The balance of the fund as of December 31, 2023 is $18.46.
  • The Federal CARES grant funds were required to be used by states to prevent, prepare for, and respond to the coronavirus during the 2020 federal election cycle.
  • The State Election Board must provide a drug-free workplace as a condition of receiving the Federal grants.
