Beneficial Reuse Requests

Oklahoma Administrative Code (“OAC”) 252:515-1-7 allows DEQ to make a determination that a waste material may be beneficially reused upon evaluating a proposal for beneficial reuse. The evaluation must take into consideration the contemplated use of the material and potential effects on human health and the environment.

Application

The Beneficial Reuse Request (“BRR”) application is located on DEQ’s online reporting system. After opening the link, type “Beneficial Reuse Requests” in the search bar. Beneficial Reuse Requests can be found here. You will be required to make an account prior to beginning the application.

About BRRs

  • Only the waste generator may submit a BRR application.
  • Only one waste material with one proposed reuse method may be evaluated per application.
  • DEQ may issue a one-time BRR approval for a single reuse method. Depending on the type of request, annual renewal may be required.
  • A new application must be submitted to DEQ if any of the submitted information changes. This may include changes to the material reuse location, waste volume, process of generation, analytics, etc.
  • DEQ may conduct an on-site inspection to determine the waste is being reused as described in the application.
  • DEQ reserves the right to amend any determinations if the reuse is found to cause adverse environmental conditions. DEQ may revoke approval at any time.

This application is to be submitted for the reuse of solid wastes other than liquids, sludges, and/or wastes originating from either an OPDES-permitted industrial wastewater surface impoundment or from a water or wastewater treatment plant. Approval for reuse of these types of material may fall under DEQ’s Water Quality Division (“WQD”). Please contact WQD at (405) 702-8100 for questions related to the reuse of these types of material.

Analytics: once the request has been reviewed, DEQ may provide a sampling protocol & a list of required analytics. Analytics may be submitted in advance, but please be aware that additional analysis may be required. The required analytics are based on the material and the process of generation.
