The below listed archived records are provided free of charge to the public.  Save time and money by utilizing this self service function provided by the agency.  All parties seeking breath testing instrument maintenance records can easily locate the associated maintenance packet by referencing the dry gas canister installation date listed on the breath test affidavit generated and printed by the automated analyzer.

Overview

Open Records requests may be submitted via the following methods listed below.  An invoice in the amount of $0.25 per page for uncertified copies, $1.00 per page for certified copies, and $15.00 per CD for electronic copies of records will accompany your documents.  Costs of email return requests will be treated at $0.25 per page and will be uncertified copies.   

Requests Pertaining to Breath Test(s)/Data and/or Refusal(s)/Data

The following list below has been created in efforts to aid individuals in requesting agency records available to the public, with some italicized exceptions, regarding evidential breath alcohol testing instrumentation maintained by the agency during the normal course of business and may be supplemented or amended by the agency as necessary to adopt new instrumentation, comply with administrative rules, comply with statutory laws, or comply with internal agency policies.

A. Regarding evidential breath testing, the following records are available upon request but are not limited to:

  1. Impaired Driving Affidavits and/or exception messages received and stored in a database (unsigned) – requires submission of DPPA BOT Form ADM 3.2 or personal information is redacted
  2. Digital table of testing data - requires submission of DPPA BOT Form ADM 3.2 or personal information is redacted
  3. Director approved forms for impaired driving affidavits
  4. Implied Consent Advisories distributed by the agency

B. Regarding evidential breath testing instrumentation, the following records are available upon request but are not limited to:

  1. Digital table of maintenance data
  2. Maintenance Service Packets created pursuant to administrative rule and internal agency policy
  3. Reported issues and troubleshooting
  4. Instrument location history
  5. Agency instrument evaluation reports 
  6. Instrument purchasing records 

Pursuant to Oklahoma Statute 51 O.S. §24.5A(1)(c); personal information within driver records is confidential and protected. The Federal Driver’s Privacy Protection Act (DPPA), 18 U.S.C. § 2721-2725, regulates access to personal information obtained from motor vehicle records. Under 18 U.S.C. § 2721-2725 and 51 O.S. §24.5A(1)(c), the Oklahoma Board of Tests for Alcohol and Drug Influence will make records containing personal information obtained from motor vehicle records available to a qualified Requester based on the Requester’s certification that the Requester is authorized to obtain and use the records pursuant to 18 U.S.C. § 2721-2725.

No open record requests requesting personal information pertaining to a driver record shall be released without the following form, BOT ADM 3.2, accompanying the request.

In order to ensure that the correct breath testing records are returned in a timely manner pursuant to the Oklahoma Open Records Act, Title 51 of the Oklahoma Statutes, please include the following information in your request:

  • Serial number of the device; 
  • Date of test

General Open Record Requests

All other requests including but not limited to correspondence, ignition interlock device certifications, service center inspections, etc. may also be requested utilizing the submission methods below.   Ignition interlock device records are not records of the Board; therefore, they do not fall under the Oklahoma Open Records Act.  The Board has view access authorization pursuant to the administrative rules regarding ignition interlock data.  The Board is authorized to assist law enforcement agencies conducting investigations that require ignition interlock data.
