Re: Public Access Counselor Advisement – Complaint Nos. 2026-10, 2026-012, & 2026-025

Dear Counsel,

This is an official advisement regarding the above-referenced complaints (“Complaints”) submitted to this office pursuant to 51 O.S.Supp.2025, § 24A.40. The Public Access Counselor (“PAC”) received the Complaints on February 13, 2026 from Amber Robinson Rodriquez, a private citizen. The Complaints allege that the City of Claremore (“City”) improperly denied requests under the Oklahoma Open Records Act (“ORA”) for (i) invoices paid by the City as reflected in agenda items from a city council meeting (Compl. 2026-10 & 12), and (ii) a specific legal memo and purchase and sale agreement mentioned in a law firm’s invoice to the City (Compl. 2026-25). According to the Complaint, the City did not respond to her request for invoices, and claimed it was not in possession of the legal memo and purchase and sale agreement.

Per the terms of 51 O.S.Supp.2025, § 24A.40(F), I conducted an initial review and determined the Complaints warranted a response from the City. In its response, the City argues that it provided all responsive invoices to Ms. Robinson Rodriguez, and that the legal memo was prepared for a different public body, the City does not have a copy, and it is subject to attorney-client privilege.

Upon review of the records provided by the City and consideration of the City’s response, I have determined the following:

  1. The invoices and legal memo are records as defined by the ORA. 51 O.S.Supp.2025, § 24A.3(1). As such, they must “be open to any person” unless otherwise exempt by virtue of another provision of the ORA. Id. § 24A.5.
  2. With regard to the invoices in Complaints 2026-10 & 12, Ms. Robinson Rodriguez requested the records on January 5, 2026 and the City credibly claims that it provided all responsive records in its possession by January 21, 2026.
  3. With regard to the records referenced in Complaint 2026-25, the City credibly claims that while the City paid for the legal memo, it was prepared for and delivered to a distinct and different public body—the Claremore Industrial and Economic Development Authority– and is not in the City’s possession.

Based on the information available to me at this time, I conclude that the City has responded in good faith to Ms. Robinson Rodriguez’s requests. Under title 51, section 24A.40(G), no further response to the above-referenced Complaints is required. If you have any questions, please do not hesitate to contact me at (405) 522-2771 or by email at opengov@oag.ok.gov.

Sincerely,

Anthony Sykes
