Re: Public Access Counselor Complaint No. 2025-061

Dear Counsel,

This is an official advisement regarding the above-referenced complaint (“Complaint”) submitted to this office pursuant to 51 O.S.Supp.2025, § 24A.40. The Public Access Counselor (“PAC”) received the Complaint on October 6, 2025 from Josh Lee, a private citizen. The Complaint alleges that the Oklahoma County Clerk (“Clerk”) did not respond to Mr. Lee’s request under the Open Records Act (“ORA”) for certain fee schedules.

Per the terms of 51 O.S.Supp.2025, § 24A.40(F), I conducted an initial review and determined the Complaint warranted a response from the Clerk, who responded—via the Oklahoma County District Attorney—that the responsive records had been mailed to Mr. Lee and that his phone calls to the Clerk had been returned.

It appears to me that the Complaint stems from a miscommunication between the parties. In the spirit of transparency, I would urge the Clerk to collect and resend the requested records to Mr. Lee. By copy of this advisement, I would urge Mr. Lee to contact the Clerk to ensure that his correct mailing or email address is on file. If either party has questions or concerns, please do not hesitate to contact me at (405) 522-2771 or by email at opengov@oag.ok.gov.

Sincerely,

Anthony Sykes
