Re: True North Engineering and E.H. “Gene” Robertson, Case No. 2026-022

Dear Executive Director Hart:

This office has received your request for a written Attorney General Opinion regarding disciplinary action the State Board of Licensure for Professional Engineers and Land Surveyors intends to take in Case No. 2026-022 against True North Engineering (Certificate of Authorization No.: None) (the “Firm”) and E.H. “Gene” Robertson (Certificate of Licensure No.: None) (“Robertson”) (collectively the “Respondents”).

Oklahoma Statutes title 59, section 475.8(A) empowers the Board of Licensure for Professional Engineers and Land Surveyors to regulate the practice of engineering in the State of Oklahoma. Under 59 O.S.Supp.2024, § 475.21(A)(2), an engineering firm must be issued a certificate of authorization by the Board for the Firm to operate and perform services in Oklahoma. The Board may suspend the license of any person who is found guilty of certain enumerated grounds, Id. § 475.18(A)(1–16), including:

  1. “Any fraud, misrepresentation, gross negligence, gross incompetence, misconduct or dishonest practice, in the practice of engineering or surveying.” Id, § 475.18(A)(2);
  2. “Failure, within thirty (30) days, to provide information requested by the Board or its designated staff as a result of a formal or informal investigation or complaint to the Board which would indicate a violation of this act.” Id, § 475.18(A)(6).

On September 13, 2024, in Case No. 2024-057, Respondents entered into an agreed Consent Order wherein the Firm and Robertson were each fined $1,350, and were ordered to cease and desist from practicing and/or offering to practice engineering without an active engineering license. After entry of the Consent Order, and while the Firm still lacked an Oklahoma Certificate of Authorization, the Firm conducted Oklahoma site visits and prepared reports in Oklahoma City, including: (i) a site visit on December 18, 2024 at 800 E. Britton Road, Oklahoma City, Oklahoma 73114 (Project 3) and a report dated April 1, 2025; (ii) a site visit on September 12, 2025 at 1901 North Douglas Avenue, Oklahoma City, Oklahoma 73106 (Project 1) and a report dated October 3, 2025; and (iii) a site visit on November 17, 2025 at 2000 N. Drexel Boulevard, Oklahoma City, Oklahoma 73107 (Project 2) and a report dated December 3, 2025. This conduct of the Firm fails to comply with and violates the Board’s prior Consent Order in Case No. 2024-057, in violation of 59 O.S. § 475.18(A)(9) and OAC § 245:15-23-2(c), and is, therefore, subject to and should be assessed the administrative penalties set forth in 59 O.S. § 475.20(B) and OAC §§ 245:15-23-3 and 245:15-23-18.

After a hearing on June 25, 2026, the Board concluded that Respondents both offered and/or performed engineering services without an active engineering license. Respondents are found guilty of violating the provisions of 59 O.S. § 475.21(A)(2) and OAC § 245:15-23-1(a) and are therefore subject to administrative penalties set forth in 59 O.S. § 475.20(B) and OAC §§ 245:15-23-3 and 245:15-23-18. The Board further found that the Firm is guilty of failing to comply with and violating the Board’s prior Consent Order in Case No. The Board further found that Robertson is guilty of violating the provisions of 59 O.S. § 475.18(C) because as a principal of the Firm, he did not obtain a certificate of authorization, and is, therefore, subject to and should be assessed the administrative penalties set forth in 59 O.S. § 475.20(B) and OAC §§ 245:15-23-3 and 245:15-23-18.

The Board, therefore, proposes to impose an administrative fine against Robertson totaling five thousand dollars ($5,000.00), and an administrative fine against the Firm totaling ten thousand dollars ($10,000.00), all fines due within thirty (30) days of the filing of the Board’s Order. The Board also orders the Firm to cease and desist from the practice of engineering in Oklahoma unless and until such time as they employ Professional Engineers, obtains a Certificate of Authority, and complies with all requirements of the Board’s Statutes and Rules.

It is, therefore, the official opinion of the Attorney General that the proposed action taken by the State Board of Licensure for Professional Engineers and Land Surveyors is in accordance with the State’s policy to protect public health, safety, and welfare.

Deputy General Counsel
