Dear Executive Director Barnhouse:
This office has received your request for a written Attorney General Opinion regarding the action that the Oklahoma Board of Nursing (“Board”) intends to take against the single-state registered nursing license of Amber May Valentine (“Respondent”). Respondent holds a single-state registered nurse (“RN”) license in the State of Oklahoma, License No. R0083142, issued by the Board. Respondent’s license is currently suspended.
On July 27, 2012, Respondent's single-state license to practice registered nursing was suspended for Respondent’s failure to comply with the terms of Respondent’s Stipulated Order. On June 18, 2025, Respondent’s Evaluation was received in the Board office and met the Board's Evaluation Criteria. On September 25, 2025, Respondent submitted to the Board a complete Reinstatement or Return to Active Status of Licensure single-state application to practice as an RN in the State of Oklahoma.
On June 30, 2026, Respondent was mailed a Notice of Hearing before the Board for the review of the Respondent's Board-ordered Evaluation and Respondent’s Reinstatement Application. On July 20, 2026, the Board received Respondent’s Response and Notice of Appearance, wherein the Respondent admitted to all of the allegations in the Amended Order to Appear and Show Cause. After reviewing Respondent’s confidential Evaluation in executive session on July 30, 2026, the Board found that Respondent failed to Show Cause why her license should not be revoked or other action taken by the Board.
The Board proposes to approve Respondent’s application to practice registered nursing and refer Respondent to the Board’s Peer Assistance Program (“PAP”) with RN license temporarily suspended pending entry to PAP within sixty (60) days. If Respondent fails to enter PAP and/or defaults/terminates from PAP, the Board proposes to revoke Respondent’s RN license for 2 years. If the license is revoked, Respondent must meet the Guidelines for Individuals Requesting Reinstatement After Suspension, Surrender or Revocation for Misappropriation or Misuse of Drugs/Alcohol and pay an administrative penalty of $2,000.00. Upon reinstatement after revocation, Respondent will be re-referred to PAP.
It is, therefore, the official opinion of the Attorney General that the Oklahoma Board of Nursing has adequate support for the conclusion that this action advances the State’s policy to protect public health, safety, and welfare by ensuring nurses comport themselves with the standards of professional conduct at all times.
