Dear Dr. Boggs:
This office has received your request for a written Attorney General Opinion regarding action that the State Board of Medical Licensure and Supervision (“Board”) intends to take in the above-referenced case. Cole Brett Cargill (“Defendant”) holds a Respiratory Care License number 6321 in the State of Oklahoma.
The Oklahoma Respiratory Care Practice Act (“Act”) authorizes the Board to revoke the license or order other appropriate sanctions if the Board finds that the licensee “[h]as been guilty of unprofessional conduct.”1 59 O.S.2021, § 2040(9). The Act also requires that “[u]pon proof of a felony conviction by the courts or any plea of a felony, the Board shall revoke the license of the physician or other licensee of the Board. . . . Court records of such a conviction shall be prima facie evidence of the conviction.” 59 O.S. § 513(A)(3),
In the above case, Defendant pled No Contest to one felony count of Child Endangerment (DUI) and one misdemeanor count of Driving Under the Influence of Alcohol in Oklahoma County criminal case number CF-25-851 on April 29, 2025. Defendant was sentenced to a seven (7) year deferred sentence on both counts.
After a hearing on July 30, 2026, the Board proposes to revoke Defendant’s Respiratory Care License. It is, therefore, the official opinion of the Attorney General that the State Board of Medical Licensure and Supervision has adequate support for the conclusion that this board action advances the State’s policy of protecting the health, safety, and well-being of the citizens of Oklahoma.
