Dear Executive Director Barnhouse:
This office has received your request for a written Attorney General Opinion regarding action that the Oklahoma Board of Nursing (“Board”) intends to take in the above-referenced case. Respondent held a single-state registered nurse (RN) license and an advanced practice registered nurse-certified nurse practitioner license (APRN-CNP) in Oklahoma. The Respondent’s RN and APRN-CNP licenses were revoked by the Board on June 12, 2025, for noncompliance with a Board Order(s) in Cases No. 3.20223090033.24 and 3.2020120063.23.
The Oklahoma Nursing Practice Act (“Act”) authorizes the Board to discipline a nurse who violates an order of the Board.” 59 O.S.2021, § 567.8(B)(9).
On July 30, 2025, the hearing and oral argument on Respondent’s Request for Reconsideration occurred. The Board proposes to deny Respondent’s Request for Reconsideration as Respondent’s request was filed outside the allowable timeframe. Additionally, Respondent’s Request is moot since he previously requested reconsideration of the September 22, 2022 Order and was denied and which was later affirmed by the Tulsa County District Court in Case No. CV-2023-416. That case is now being appealed to the Oklahoma Supreme Court in Case No. DF-122897. In this matter, the administrative case is closed as a final determination has already been decided by the Board. Further, the appeal of the Board’s decision on whether to grant reconsideration of the September 29, 2022 Supplemental Order has removed jurisdiction over this matter from the Board to the appellate court.
It is, therefore, the official opinion of the Attorney General that the Oklahoma Board of Nursing has adequate support for the conclusion that this action advances the State’s policy to protect public health, safety, and welfare by ensuring nurses meet minimum standards of professional conduct.
