Dear Executive Director Kidd: 

This office has received your request for a written Attorney General Opinion regarding action that the Oklahoma Board of Chiropractic Examiners (“Board”) intends to take in Case Nos. 24-2022 and 31-2022. 

The Oklahoma Chiropractic Practice Act (“Act”) authorizes the Board to impose discipline on a chiropractic physician when the Board finds “by clear and convincing evidence” that the chiropractic physician has violated the Act or rules of the Board. 59 O.S.2021, § 161.12(B)(12–13); OAC 140:15-7-5(15). Such discipline may include suspension of a license. 59 O.S.2021, § 161.12 (A)(2). 

In March 2023, the Board entered a Consent Order (“CO”). Among other things, the CO required Respondent to complete an Ethics and Boundaries assessment examination, submit to a psychological evaluation and have regular sessions with a psychologist or psychiatrist during Respondent’s probation period. At a March 2024 Board hearing, Respondent admitted his failure to comply with the CO. The Board tabled a decision on the matter until the April 2024 hearing, to allow Respondent time to comply with the CO. Respondent failed to appear at the April 2024 Board hearing. Finding clear and convincing evidence that Respondent violated the Act and Board rules, the Board proposes to suspend Respondent’s license. The Board may reasonably believe the proposed action is necessary to deter future violations 

It is, therefore, the official opinion of the Attorney General that the Oklahoma Board of Chiropractic Examiners has adequate support for the conclusion that this action advances the State of Oklahoma’s policy to protect public health, safety, and welfare.
