Dear Dr. Stout: 

This office has received your request for a written Attorney General Opinion regarding action that the State Board of Medical Licensure and Supervision (“Board”) intends to take regarding application 41399. 

The Oklahoma Allopathic Medical and Surgical Licensure and Supervision Act, 59 O.S.2021, §§ 481–518, authorizes the Board to deny a license application of a physician when: (1) the applicant “use[s] . . . false or fraudulent information . . .; (2) a state has suspended or revoked the applicant’s license, unless reinstated in the same state; and (3) another state has refused to grant licensure for a reason other than examination failure. 59 O.S.2021, § 493.1(L)(1-3). 

Finding a legal basis for licensure denial by citing all three bases above, the Board proposes to deny Applicant’s application for a full medical license. The Board may reasonably believe that the proposed action is necessary to protect the public. 

It is, therefore, the official opinion of the Attorney General that the State Board of Medical Licensure and Supervision has adequate support for the conclusion that this board action advances the State’s policy of protecting the health, safety, and well-being of the citizens of Oklahoma.
