Re: Loftis; Complaint No. 027-2026

Dear Executive Director Kidd:

This office has received your request for a written Attorney General Opinion regarding action that the Oklahoma Board of Chiropractic Examiners (“Board”) intends to take in the above-referenced case. Mark Loftis, D.C. (“Respondent”) holds Chiropractic License No. 4152.

The Oklahoma Chiropractic Practice Act (“Act”) authorizes the Board to impose discipline on a chiropractic physician when the Board finds “by clear and convincing evidence” that the chiropractic physician has violated the Act or rules of the Board. 59 O.S.2021, § 161.12(A). Such discipline may include suspension of a license. Id § 161.12(A)(2). The Board may summarily suspend a license if, “upon review of the report of the Advisory Committee, [the Board] finds that the public health, safety or welfare imperatively requires emergency action[.]” OAC 140-3-3-6; 75 O.S.2021, § 314.1.

Complaint 027-2026 was filed against Respondent by Board staff. Respondent has been convicted by a federal jury of “conspiracy to commit health-care fraud and wire fraud.” Respondent submitted bills to Federal Government HealthCare Agencies for more than $30,000,000. These actions are alleged to violate 59 O.S.2021, § 161.12(B)(1); OAC 140:15-7-5(6) and (8).

After reviewing the Advisory Committee report on October 2, 2026, at a special meeting, the Board proposes to summarily suspend Respondent’s license and order that Respondent refrains from the practice of Chiropractic pending the conclusion of a full hearing before the Board on this matter.

It is, therefore, the official opinion of the Attorney General that the Oklahoma Board of Chiropractic Examiners has adequate support for the conclusion that this action advances the State of Oklahoma’s policy to protect public health, safety, and welfare.

Deputy General Counsel
