Re: Mickish, Case No. 2025-1724

Dear Executive Director Hendrick:

This office has received your request for a written Attorney General Opinion regarding disciplinary action the State Board of Pharmacy (“Board”) intends to take in the above-referenced case. Mickish (“Respondent”) held Pharmacy Technician Permit No. T-29642, which was cancelled on July 1, 2025, after Respondent failed to renew it following its expiration on May 31, 2025.

The Oklahoma Pharmacy Act authorizes the Board to regulate the practice of pharmacy. 59 O.S.Supp.2022, § 353.7(1).  The Board has jurisdiction to hear this matter pursuant to Oklahoma Statute title 59, sections 353.7(12) and 353.26(A). The Board may revoke the license of any person who violates any provision of the Oklahoma Pharmacy Act, the Uniform Controlled Dangerous Substances Act, or “[c]onducts himself . . . in a manner likely to lower public esteem for the profession of pharmacy,” or “[e]xercises conduct and habits inconsistent with the rules of professional conduct established by the Board.” 59 O.S.2021, § 353.26(A)(1), (2), (5) and (8). The Uniform Controlled Dangerous Substances Act makes it unlawful for any person to possess a controlled dangerous substance knowingly or intentionally without a valid prescription. 63 O.S.Supp2023, § 2-402(A)(1).  A registrant[1] is required to “conduct business in conformity with all . . . laws” and “in a manner that will entitle them to the respect and confidence of the community. . . .” OAC 535:25-7-3(a), (b).  A registrant violates the rules of registrant conduct when the registrant commits theft while working. OAC 535:25-9-7.

Respondent was employed as a pharmacy technician at a Reasor’s pharmacy.  On May 9, 2025, the Board office received a DEA 106 form from that Reasor’s pharmacy dated May 9, 2025.  Upon investigation, Respondent admitted that she had been stealing Hydrocodone and Alprazolam stock bottles and customer bottles.  Respondent provided a voluntary written statement from Respondent on May 13, 2025, admitting to stealing and using one bottle of Alprazolam of 60 tablets for personal use.  Respondent also admitted to stealing and selling two stock bottles of hydrocodone with 100 tables in each for $5.00 per pill to people she knew.  Respondent also admitted to stealing and selling one bottle of Hydrocodone/Acetaminophen 10mg/325mg tables with 140 tablets through the pharmacy drive thru.  On May 13, 2025, Respondent was terminated from the Reasor’s pharmacy.  

After a hearing on August 13, 2025, the Board concluded that Respondent violated 59 O.S. 353.24(A)(8) and 353.26(A)(1), (2), (5) and (8), as well as OAC 535:25-9-7 and OAC 535:25-7-3(a) and (b). The Board proposes to permanently revoke Respondent’s Pharmacy Technician Permit (No. T-29642) and assess a two-thousand-dollar ($2,000) fine to be paid to the Board within thirty (30) days of this Board’s Order. 

The Board may reasonably believe the proposed action is necessary to “promote, preserve and protect the public health, safety and welfare by and through the effective control and regulation of the practice of pharmacy.” See 59 O.S. § 353(B).  It is, therefore, the official opinion of the Attorney General that the State Board of Pharmacy’s proposed action is in accordance with the State’s policy to protect public health, safety, and welfare.
