Representing Your Business in Wage Claim Proceedings
Employers may provide information to the Oklahoma Department of Labor during a wage claim investigation. However, representation requirements differ depending on the stage of the process.
Important Notice for Corporations, LLCs, and Similar Employers:
Non-lawyers are allowed to provide information to the Department on behalf of a corporation, LLC, or similar employer during a wage claim investigation.
If the Department issues an order of determination to a corporation, LLC, or similar employer, and the employer wants to contest the order, a licensed attorney representing the employer must request a hearing to contest the order.
A non-lawyer cannot request a hearing, or appear in administrative court, on behalf of a corporation, LLC, or similar employer.
Employers are encouraged to review applicable wage and hour statutes and administrative rules to understand their obligations and procedural rights. Wage claim proceedings are conducted pursuant to Oklahoma law and the Oklahoma Administrative Procedures Act.
