Business License Guide

Business licenses are designed for ongoing commercial operations, such as manufacturers (brewers, distillers, winemakers), wholesalers, retailers (spirits, beer, wine), mixed beverage establishments, caterers, and other permanent venues involved in the production, distribution, or sale of alcoholic beverages.

Business License Types:


Distributor and Wholesaler Licenses


Authorizes the holder to purchase and import cider into this state from holders of manufacturer’s licenses and their agents who are the holders of manufacturer’s agent licenses and to purchase and import beer or cider from holders of a brewer or small brewer license.

Authorizes the holder to sell beer and cider in retail containers in state to beer distributors and out of state to qualified persons.

Authorizes the holder to donate beer and cider to organizations for charitable purposes.

SED – Brewpub, Small Brewer, and Winemaker Self-Distribution


Authorizes holders of a brewpub license to manufacture, bottle, package, and store beer on the licensed premises and to sell beer produced by the licensee for on or off premises consumption.

Authorizes the holder to self-distribute the products produced by the holder of the same Brewpub license.

Authorizes holders to distribute beer and cider produced only by the same licensee to the holders of the following: Retail Beer license, Retail Spirits license, Mixed Beverage license, Beer and Wine license, Caterer’s license, Special Event license, Public Event license, Charitable Auction license, or Brewpub license.

Note: A small brewer shall elect to distribute through a distributor or to self-distribute; however, they may not do both simultaneously.

Intended Use Cases: Small Brewer who intends to self-distribute and not use a beer distributor or wine and spirits wholesaler

Authorizes a licensed winemaker in Oklahoma or out of state to distribute its own wine directly to the holders of a Retail Spirits license, Retail Beer license, Retail Wine license, Mixed Beverage license, Beer and Wine license, and to restaurants in this state.

Note: A winemaker may self-distribute if they produce not more than 15,000 gallons of wine annually and may sell directly to retail package stores, mixed beverage licensees, beer and wine licensees, and restaurants.

Intended Use Cases: Winemaker who intends to self-distribute and not use a beer distributor or wine and spirits wholesaler

Authorizes the holder to purchase and import spirits and wines from holders of a Manufacturer or Nonresident Seller license and their agents who hold Manufacturer’s Agent licenses. 

Authorizes the holder to purchase and import into this state spirits and wines from licensed distillers, rectifiers, and winemakers in this state.

Authorizes the holder to sell wine and spirits in retail containers in this state to the holders of a Retail Spirits license, Mixed Beverage license, Caterer license, Special Event license, Public Event license, Hotel Beverage license, and Airline/Railroad license.

 Authorizes the holder to maintain not more than 3 self-owned or leased and self-operated bonded warehouses where product is received and unloaded prior to distribution to retailers for a minimum of 24 hours.

Note: Wine and Spirits Wholesalers shall NOT accept payment by credit card.

Manufacturer and Importer Licenses


Authorizes the holder to manufacture, bottle, package, and store beer and cider on the licensed premises.

Authorizes the holder to sell beer and cider in this state to holders of Beer Distributor licenses and retail licenses or to sell to qualified persons out of this state.

Authorizes the holder to sell beer produced by the licensee for on or off-premises consumption on the brewery premises and to sell beer at public events.

Note: Holders of a Brewpub license may also hold a Mixed Beverage license, Beer and Wine license, Caterer’s license, and a Brewpub Self-Distribution license.

Intended Use Cases:
Brewery selling brewed products on premises in conjunction with food

Authorizes the holders to formulate, manufacture, bottle, package, and store charitable collaboration beer, or any part thereof, on the licensed premises.

Authorizes the holders to sell charitable collaboration beer in state to holders of Beer Distributor licenses and retail licenses or out of state to qualified purposes for the sole purpose of fundraising for a stated charitable purpose.

Authorizes the holders to sell charitable collaboration beer for on or off-premises consumption and at public events.

Note: If either brewer holds a self-distribution license, the holder may self-distribute the charitable collaboration beer.

Intended Use Cases:
Two licensed Brewers providing a product for charitable sales purposes

Authorizes the holder to manufacture, bottle, package, and store spirits on the licensed premises.

Authorizes the holder to sell spirits in this state to licensed wholesalers and manufacturers and out of state to qualified persons.

Authorizes the holder to purchase and import spirits from licensed distillers and rectifiers in this state for manufacturing purposes.

Authorizes the holder to sell spirits produced by the same licensee for on or off-premises consumption and at public events.

Note: The physical location of the distillery must be Oklahoma to apply for this license.

Intended Use Cases:
Distiller producing spirits in the state of Oklahoma

Authorizes distillers, winemakers, spirits manufacturers, and importers and brokers seeking to sell wine and spirits in Oklahoma to solicit and take orders for wine and spirits from holders of licenses authorized to import, ship, deliver, or cause to be shipped or delivered the same into the state.

Note: No licensee in this state is authorized to import alcoholic beverages from without this state from any person not holding a valid Brewer, Small Brewer, Manufacturer or Nonresident seller license.

Note: The Non-Resident Seller license cannot be used to import beer, cider, or any malt product.

Reporting Requirements: The holder of a Manufacturer or Nonresident Seller license shall, upon consignment of any wine and spirits to an importer in Oklahoma, forward a true copy of the invoice and bill of lading to the ABLE Commission.

Out of state 1) broker or 2) manufacturer (winery or distillery) intending to import 1) others wine and spirits products or 2) their own wine and spirits products into Oklahoma

Authorizes the holder to manufacture, bottle, package, and store beer and cider produced by the licensee on the licensed premises.

Authorizes the holder to sell beer and cider in this state to holders of beer distributor licenses and out of state to qualified persons.

Authorizes the holder to sell beer and cider produced by the licensee for on or off-premises consumption to consumers on the licensed premises and at events attended by the public.

Note: Holders of an Oklahoma Small Brewer license may host off-site events and also hold a Brewpub license.

Authorizes the holder to purchase from licensed manufacturers in this state and to import wine and spirits into this state for manufacturing purposes.

Authorizes the holder to sell, ship, or deliver sacramental wine to any religious corporation or society in Oklahoma holding a valid 501(a) tax exemption and listed as an exempt organization in Section 501(c)(3).

Intended Use Cases:
Supply sacramental wine to religious organizations

Authorizes the holder to manufacture and bottle wines produced by the small farm winery.

Authorizes the holder to establish Satellite Tasting Rooms and serve for on-premises consumption or sell sealed containers for off-premises consumption. The holder may also purchase beer from an authorized vendor and sell for on-premises consumption only.

Authorizes the holder to display an “Oklahoma Grown” sticker if 75% of the grapes utilized are grown in Oklahoma.

Winery in Oklahoma that produces less than 25,000 gallons per year

Authorizes to manufacture, blend, mix, treat, bottle, package and store wine on licensed premises not containing more than 24% ABV.

Authorizes the holder to sell wine in this state to licensed manufacturers and wholesalers and out of state to qualified persons.

Authorizes the holder to establish Satellite Tasting Rooms and serve for on-premises consumption or sell sealed containers for off-premises consumption. The holder may also purchase beer from an authorized vendor and sell for on-premises consumption only.

On-Premise Retail Licenses


Authorizes the holder to purchase beer and wine in retail containers from licensed wholesaler, beer distributor, small brewer self-distribution, or brewpub self-distribution licensees and to sell, offer for sale, and possess beer and wine for on-premises consumption only.

Golf courses, country clubs, and marinas may sell beer and wine for off-premises consumption if they meet the proper NAICS definition and limit sales to 2 sealed original packages to one person.

Authorizes the holder to sell or serve alcoholic beverages in 50ml spirits (mini liquor bottles), 187ml wine (small wine bottles), and 12oz malt beverages (beer, cider) which are distributed from a hotel room mini-bar.

Authorizes the holder to sell and possess mixed beverages for on-premises consumption.

Note: Holders of a mixed beverage license may also hold a Retail Beer and/or Retail Wine license.

Authorizes the holder to purchase beer from a beer distributor or the holder of a small brewer self-distribution license.

Authorizes the holder to sell the same for off-premises consumption only and not for resale and to host alcoholic beverage tastings.

Note: No holder of a Retail Beer license may sell a malt beverage in excess of 15% ABV.

Shipping and Transportation


Authorizes the holder to sell or serve alcoholic beverages in any size container on a commercial passenger airplane or vessel operated in compliance with a valid license, permit, or certificate issued under the authority of the United States and store alcoholic beverages at any airport or facility regularly served by the licensee.

Authorizes the holder, which may be any common carrier operating under a certificate of convenience and necessity issued by any authorized federal or state regulatory agency, to transport alcoholic beverages into, within, and out of this state.

Exception: The holder cannot transport wine sold directly by a winemaker or a winery to a retail package store or restaurant.

Reporting Requirements: All carriers that bring, carry, or transport wine for delivery to any person in the state, except wine or spirits wholesalers or beer distributors, shall report quarterly all known wine shipments.

Authorizes the holder to ship up to six 9-liter cases of wine annually directly to an Oklahoma resident who is 21 years of age or older for such resident’s personal use and not for resale. The holder must be a valid winery licensed in this or any other state.

Note: No resident shall be permitted to purchase more than thirty 9-liter cases of wine per year by this method.

Authorizes the holder to sell or serve alcoholic beverages in any size container on a commercial passenger airplane or vessel operated in compliance with a valid license, permit, or certificate issued under the authority of the United States and store alcoholic beverages at any airport or facility regularly served by the licensee.

Authorizes the holder to receive and store alcoholic beverages and nonalcoholic beverages for the holders of storages licenses.

Note: No goods, wares, or merchandise other than alcoholic and nonalcoholic beverages may be stored in the same bonded warehouse with alcoholic beverages.

Authorizes the holder to store alcoholic beverages in a public warehouse holding a bonded warehouse license.

A storage license may be issued to the holder of a Brewer, Distiller, Winemaker, Rectifier, Wine or Spirits Wholesaler, Beer Distributor, Nonresident Seller, Mixed Beverage, Caterer, Public Event, or Hotel Beverage license.

Holders of a Small Brewer, Brewpub, Special Event, or Public Event license shall not be required to obtain a Storage license.

Note: No goods, wares, or merchandise other than alcoholic and nonalcoholic beverages may be stored in the same bonded warehouse with alcoholic beverages.
