Non-Sufficient Fund On Hold List
Pursuant to OCA § 46:10-3-17
Pursuant to OCA § 46:10-3-16 (attach pdf form) No retail licensee, manufacturer, caterer, or any employee of such licensee, shall issue a check or make an electronic payment to a licensed Wine and Spirits Wholesaler, Beer Distributor, or self-distributor unless there are enough funds available to cover the payment when it is processed. A license placed on the NSF Hold List is prohibited from purchasing inventory from any wholesaler, beer distributor or self-distributor until any outstanding balances is paid in full.
Notification to the ABLE Commission
- Any check or electronic payment returned for insufficient, or no funds shall constitute that the licensee accepted credit from the wholesaler or distributor. If the outstanding balance is not paid in full within three (3) business days following notice of dishonor, the wholesaler or distributor shall immediately notify the ABLE Commission via email to catherine.otey@able.ok.gov. - The Wholesaler or Distributor will send the notification form to the ABLE Commission with a front/back copy of the returned check or a copy of the returned ACH notice. If the license being placed on hold has multiple locations, each location’s license should be listed on the form. A separate form should be submitted for each returned item.
- Upon receipt of notification, the ABLE Commission will place the licensee on the NSF Hold List via email to each wholesaler and distributor. Placement on and removal from the NSF Hold List will occur at designated times, 9am and 4 pm. For these purposes, any NSF Hold added or released between 4:00 p.m. and 9:00 a.m. shall be reflected on the list at the 9:00 a.m. update. Any NSF Hold added or released between 9:00 a.m. and 4:00 p.m. shall be reflected on the list at the 4:00 p.m. update
- A license placed on the hold list can only be released when the ABLE Commission receives notification from the wholesaler or distributor which placed the license(s) on the list.
- A license placed on the NSF Hold List is prohibited from purchasing alcoholic inventory from any wholesaler or distributor until the outstanding balance is paid in full. Placement on the list does not prohibit the licensee from continuing to operate their licensed business.
