404 Permitting

The Clean Water Act (CWA) is the federal law that governs water pollution. Under this act, the U.S. Army Corps of Engineers is responsible for Section 404 permitting, which regulates the discharge of dredged and fill material into waters of the United States (WOTUS), including wetlands.

ODOT's 404 Permitting personnel offer assistance by:

  • Determining which 404 permit is required for a project;
  • Identifying efforts to avoid and minimize these impacts to project sites; and
  • Assessing how these impacts will be compensated.
