Clean Slate-Criminal History Expungements in Oklahoma

During the 2022 legislative period, House Bill (HB) 3316 was passed by the legislature and later signed by Governor Stitt. HB3316 modified Title 22 O.S. Section 18 and 19 to create a state initiated criminal history expungement process widely known as “Clean Slate.” HB3316 required implementing this process three (3) years after the bill’s effective date of November 1, 2022, pending the availability of funding. The Clean Slate expungement process will enable individuals with an eligible record to have the record sealed without filing a court petition. What are the Clean Slate steps? The Clean Slate process incorporates many of the same steps as a petition-based expungement. As currently written, the process includes the following steps: • Every month, the OSBI will identify and provide a list of eligible records to the prosecuting and the arresting agency. • The OSBI, arresting agency, and prosecuting agency have 45 days to review records and record whether or not there is an objection. • The OSBI will provide a list of records that have been reviewed by all three entities with no objections to the appropriate court. • Each court will need to review records on this list and return an expungement order if they concur that the record qualifies for expungement.
