What is Changing and When Does it Take Effect?

Effective July 1, 2013, Assisted Living providers with an ADvantage Waiver Contract are deemed “community services providers” who contract with, or are licensed or funded by OKDHS or who contract with Oklahoma Health Care Authority (OHCA) to provide residential or employment services to service recipients through Developmental Disabilities Services Division (DDSD) Home and Community-Based Services (HCBS) Waivers.

What Action is the Assisted Living Provider Required to Take?

The contracted ADvantage Assisted Living providers will be required to conduct a search of criminal history records and the OKDHS Registry for each potential employee who is not a licensed health professional and who will provide, for compensation or as a volunteer, on a full-time or part-basis, health-related services, training or supportive assistance to a service recipient.

Where is the Policy Located and Who Does it Involve?

The policy and instructions for this new required process for ADvantage Assisted Living providers is found in OAC 340:100-3-39(e)(1) -  Provider pre-employment responsibilities regarding community service workers and may be found on the OKDHS website under Library -- Policy. This requirement also applies to applicants for supervisory, management, or administrative positions, when the applicant is to provide, on a full-time or part-time basis, supportive assistance, health-related services, or training to a service recipient.
