OKDHS:2-1-5. Resignation

(a) To voluntarily resign in good standing from Oklahoma Human Services (OKDHS), per Oklahoma Administrative Code (OAC) 260:25-11-132, an employee submits a letter of resignation to that employee’s supervisor not less than 14-calendar days prior to the employee's last day of work. 

(b) The supervisor, within five-business days of receipt of the resignation letter or a verbal resignation, provides the employee with an acknowledgement letter and forwards a copy of the acknowledgement letter, with the attached resignation letter to the local administrator and OKDHS Human Resource Management (HRM).

(c) At the supervisor's discretion, the employee's last workday may be changed, when mutually agreed upon in writing, and that documentation is forwarded to OKDHS HRM.

(d) When the employee’s resignation is submitted while disciplinary action is pending due to allegations of gross misconduct committed by the employee, the supervisor communicates to the employee that the matter will be referred to the HRM director.  The HRM director or designee either processes the resignation without comment or, alternatively, informs the employee in writing that the resignation will be accompanied with the placement of a letter in the employee's permanent personnel file that states the employee's resignation was in lieu of anticipated termination for gross misconduct. 

(e) Gross misconduct, as opposed to misconduct in general, is defined as misbehavior that is egregious, severe, or repeated after previous warnings to cease such behavior.  Examples of gross misconduct include, but are not limited to:

(1) allegations of the employee engaging in potentially serious criminal conduct;

(2) significant abdication of work responsibilities detrimental to OKDHS operations;

(3) violence or threat of violence in the workplace; and

(4) egregious acts of sexual harassment, discrimination, or both. 

(f) As with any resignation, employees who resign in lieu of termination do not have a right to file a complaint with the Civil Service Division.

(g) Any employee resignation, including a resignation in lieu of termination, can only be withdrawn by written agreement of both the supervisor and the HRM director.  Any agreement letter approving the withdrawal of a resignation may be placed in the personnel file.

(h) Employees who resign in good standing may be considered for re-employment per employee hiring procedures for new employees.

(i) A verbal resignation is accepted in the same manner as a written one, with written documentation prepared by the supervisor or the individual receiving the resignation.
