OKDHS:10-1-29. Immigrants

     Aliens lawfully admitted for permanent residence in the United States are classified as "Immigrants" by the INS and are individuals who entered this country with the express intention of residing here permanently.

  • (1) Acceptable proof of "immigration" status is Form 1-151 or Form 1-551, Alien Registration Receipt Card, (see Section V of DHS Appendix J). Earlier versions of these cards, Form AR-3A, Alien Registration Receipt Card, (see Section I of DHS Appendix J) and AR-3 which carries the same name, are proof of permanent residency if specifically endorsed as such. Also, a Reentry Permit is acceptable proof in as much as permanent residence is a requirement of its issuance. Possession of any of these cards verifies that the individual meets the "citizenship and alienage" requirement.
  • (2) An individual who is a citizen of another country but who comes to the United States after marriage to, or to marry, a member of the armed forces of the United States would have been admitted with papers to show this status. Subsequent divorce would not affect this right, even though the individual had not become a citizen in his or her own right, and the "citizenship and alienage" requirement would be met.
  • (3) Visitors, tourists, students, temporary workers, diplomats, members of foreign information media, exchange visitors, etc., who are lawfully admitted for specific periods of time and with no intention of establishing a permanent residence in the United States are classified as "Non-immigrants" by the INS and do not meet the eligibility requirement for citizenship and alienage. These individuals are generally issued Form 1-94, Arrival Departure Record, on which an expiration date is entered. This form is not the same Form 1-94 that is issued to persons who have been paroled into the United States. Parolees carry a Form 1-94 that is titled "Arrival-Departure Record - Parole Edition". Two other forms that do not give the individual "Immigrant" status are Form 1-156, Nonresident Alien Mexican Border Crossing Card, and Form SW-434, Mexican Border Visitors Permit.
