340:75-15-47. Interjurisdictional fair hearing

The Oklahoma Department of Human Services (OKDHS) does not deny or delay placement of the child for adoption when an approved adoptive family is available outside of Oklahoma.

(1) A fair hearing may be requested by the prospective adoptive parent when placement by OKDHS with the authorized adoptive family in another state has been denied or unreasonably delayed.

(2) The out-of-state prospective adoptive parent may request a fair hearing by completing and filing Form 13MP005E, Resource Family Request for a Fair Hearing, per OAC 340:75-1-12.6(a)(2)(C).
