340:65-11-1. Purpose, legal authority, and criminal penalties

(a) Purpose. The purpose of this Subchapter is to describe voter registration rules as Oklahoma Human Services (OKDHS) is a designated voter registration agency.
(b) Legal authority. The National Voter Registration Act of 1993 [Public Law 103-31] and Section 109.2 of Title 26 of the Oklahoma Statutes requires state agencies providing public assistance, such as Child Care Subsidy, SoonerCare (Medicaid), State Supplemental Payment, Supplemental Nutrition Assistance Program, Temporary Assistance for Needy Families, or state-funded programs primarily engaged in providing services to persons with disabilities to offer voter registration services. • 1 Voter registration procedures comply with procedures issued by the Oklahoma State Election Board.
(c) Criminal penalties. Criminal penalties for improper voter registration are included in Section 1973gg-10 of Title 42 of the United States Code and the cautions portion of the State Election Board's Procedure for Voter Registration. • 2

1. Oklahoma Human Services:
(1) distributes the Oklahoma Voter Registration Application and Form 08MP007E, Voter Registration Statement;
(2) accepts completed Oklahoma Voter Registration Application forms for transmittal to the State Election Board; and
(3) stores Oklahoma Voter Registration Statements, per Oklahoma Administrative Code 340:65-11-3.
2. (a) Refer to the Procedure for Voter Registration card issued by the Oklahoma State Election Board regarding:
(1) criminal penalties for violations of the voter registration law; and
(2) actions and statements that may not be made to persons registering to vote.
(b) The worker is not subject to criminal penalties unless he or she knowingly registers an ineligible person.
