Criminal History Dispute

If a Criminal History Record Information (CHRI) or a Record of Arrest and Prosecution (RAP Sheet) is returned by the Oklahoma State Bureau of Investigations (OSBI) and/or the Federal Bureau of Investigation (FBI), OBI will mail the individual a copy of the returned criminal history record and a Criminal History Record Dispute Resolution, form 19AD005E.

Regrettably, criminal history records can be incomplete or contain errors. It is your right to review the information on your criminal history record for accuracy.

If you receive a copy of your CHRI, review it for completeness and accuracy. If the information is complete and accurate, no further action is required. You may keep the CHRI for your records.

However, if you feel your criminal history contains incorrect or incomplete information, it is your right to dispute those inaccuracies with the OSBI, for your Oklahoma, or the FBI for your national record, in accordance to Title 28, CFR, 16.34

If you feel OBI has made a decision due to inaccurate information on your criminal record, you may dispute this decision with OBI.

If you would like OBI to review your corrected criminal history or supporting documents, you may complete the Criminal History Record Dispute Resolution, form 19AD005E, and return it with the dispute resolution documents; including, but not limited to: updated CHRI, court documents, and letters from the authorized arresting state’s agency to OBI at:

Please be advised that OBI will not automatically receive an updated copy of your criminal history --after corrections are made-- unless you are fingerprinted again.

Once you have updated your state or national CHRI, you will be provided an updated and corrected copy. If you feel this information may affect the decision OBI made, please provide a copy of the updated CHRI to OBI.

OBI does not make a final determination until you have had the opportunity to dispute inaccurate information and submit documentation; or decline to do so.

We are only able to provide a copy of your criminal history if a CHRI or RAP Sheet was returned on the background check. If a name based, or fingerprint based, background check did not return a CHRI or RAP Sheet, OBI will not have any documentation available to send the subject of the background check.

From OBI:

If you do not receive a copy of your CHRI, or have misplaced it, you may contact OBI at OBI@okdhs.org to request another copy. A copy of your CHRI and a Criminal History Record Dispute Resolution, form 19AD005E, will be mailed to you. *OBI may only provide this information to the subject of the background check.

From CWS:

If you have CW involvement, you may request a copy of your CHRI from your CWS worker. CWS may provide you a copy of your CHRI and a Criminal History Record Dispute Resolution, form 19AD005E. *CWS may only provide this information to the subject of the background check.

From a child care program/QE:

Child care applicants may also request a copy of their CHRI from the child care program, GAO, or THA. The QE may provide you a copy of your CHRI and a Criminal History Record Dispute Resolution, form 19AD005E. *The child care QE may only provide this information to the subject of the background check.

From a DHS hiring authority representative:

A DHS applicant may request a copy of their CHRI from an approved DHS representative.  The DHS representative may provide you a copy of your CHRI and a Criminal History Record Dispute Resolution, form 19AD005E. *The DHS representative may only provide this information to the subject of the background check.
