Administrative Letter 19-10

Dear Provider:

House Bill 3300, the Breanne Bell Act, went into effect November 1, 2018.  The new language directs that the Department of Human Services will "develop and disseminate a form to all providers of group home services which shall be signed and witnessed by each direct care staff member working with residents notifying the staff member that the staff member may be prosecuted criminally for having sexual contact with a person in their care. 

As a result of this Act, DDS has revised the DDS-39 Employment Application Supplement to include this language.  Additionally, DDS is requiring that all community service workers, not just group home, be required to execute this form, just as it is being done now with the former DDS-39.  The revised form is attached.
