3. *APPROVAL OF MINUTES – April 20, 2017; July 13, 2017 no quorum
4. DDS UPDATE – Marie Moore Interim DDS director
The DHS budget is almost $30 million short with DDS being cut by $3 million. DDS reduced state funded contracts, adult day services, sheltered workshops and reduced the In Home Support Waiver. When the cigarette fee was determined unconstitutional, $69 million of DHS's budget went away. Until we know what the plan of action will be when Governor Fallin calls the special session, DDS will not make any cuts.
5. * APPROVAL OF RULES – Terry Trego, Policy Sub-Committee Chair
All were passed with no discussion or questions
- OAC 340:100-3-5.
- Is amended to ensure capacity assessments are completed for Class Members, or other service recipients when approved by the DDS director or designee.
- OAC 340:100-3-5.1.
- Is amended to revise the text related to the Department contracting with an agency to recruit, screen, match, monitor, and support volunteer guardians and advocates. Those activities are supported by the DDS guardianship program manager.
- OAC 340:100-3-5.2.
- Is amended to set forth revised rules designating when the Department may pay for legal fees associated with guardianship proceedings for service recipients. Legal fees may be paid for persons who are Class members or other service recipients when approved by the DDS director or designee.
- OAC 317:30-5-482.
- Is amended to remove treatment extensions authorized by DDS area managers. Authorizations for psychological services are processed through the Plan of Care review process. The description of services for prevocational services is amended to bring the description in line with CMS settings requirements for paid employment in integrated community settings.
- OAC 317:40-7-3.
- Is amended to establish service provisions for eligible members 16 years of age or older so they can access waiver employment services through the In-Home Supports Waiver when appropriate.
- OAC 340:100-17-16
- Is amended to remove provisions for therapeutic leave in state-funded employment reimbursement. State-funded therapeutic leave is eliminated because the Department's FY-2018 operating budget was reduced.
- OAC 340:100-17-30.
- Is amended to remove provisions for therapeutic leave in state-funded employment reimbursement. State-funded therapeutic leave is eliminated because the Department's FY-2018 operating budget was reduced.
- Rule impact:
- The classes of persons affected by the proposed rule changes are individuals who receive services from DDS, who bear no costs associated with the implementation of the rule.
