SUMMARY:The proposed revisions to Subchapter 39 of Chapter 2amend the rules to reflect role and purpose of the Office of Planning, Research, and Statistics (OPRS).

340:2-39-1 is amended to clarify the purpose and role of OPRS.

A.Brief description of the purpose of the proposed rule:

Purpose.The proposed revisions to Subchapter 39 of Chapter 2 of Title 340 amend the rules to reflect role and purpose of the Office of Planning, Research, and Statistics (OPRS).

Strategic Plan impact.The proposed rules clarify the purpose and function of the Office of Planning, Research, and Statistics.

Substantive changes.

340:2-39-1 is amended to clarify the purpose and role of OPRS.

Reasons.The proposed revisions clarify practices and procedures within OKDHS, in addition to providing a better-organized means of offering this information within the Oklahoma Administrative Code (OAC).

Repercussions. The proposed rules reflect current OPRS functions.If the proposed revisions are not implemented, OKDHS employees and the general public will not be informed about current practices and procedures via OAC, which will likely result in confusion in the coordination, planning, and execution of strategic goals.

Legal authority. Commission for Human Services, Article XXV, Sections 2, 3, and 4 of the Oklahoma Constitution, and, in part, Section 162 of Title 56 of the Oklahoma Statutes; and Section 45.3 of Title 62 of the Oklahoma Statutes.

Permanent approval.Permanent rulemaking approval is requested.

B.A description of the classes of persons who most likely will be affected by the proposed rule, including classes that will bear the costs of the proposed rule, and any information on cost impacts received by the Agency from any private or public entities: The classes of persons most likely to be affected by the proposed rules are OKDHS staff, including OPRS staff, executive staff, and field staff, and clients served. The affected classes of persons will bear no costs associated with implementation of the rules.

C.A description of the classes of persons who will benefit from the proposed rule: The classes of persons who will benefit are OKDHS staff and clients served.

D.A description of the probable economic impact of the proposed rule upon the affected classes of persons or political subdivisions, including a listing of all fee changes and, whenever possible, a separate justification for each: The revised rules do not have an economic impact on the affected entities. There are no fee changes associated with the revised rules.

E.The probable costs and benefits to the Agency and to any other agency of the implementation and enforcement of the proposed rule, the source of revenue to be used for implementation and enforcement of the proposed rule and any anticipated effect on state revenues, including a projected net loss or gain in such revenues if it can be projected by the Agency: The probable cost to OKDHS includes the cost of printing and distributing the rules, which is estimated to be less than $5. The revised rules will result in enhanced planning efforts that support the OKDHS mission, thus resulting in more efficient service delivery to clients and enhanced collaboration with partners.

F.A determination whether implementation of the proposed rule will have an impact on any political subdivisions or require their cooperation in implementing or enforcing the rule: The proposed rules do not have an economic impact on any political subdivision, nor will the cooperation of any political subdivisions be required in implementation or enforcement of the rules.

G.A determination whether implementation of the proposed rule will have an adverse economic effect on small business as provided by the Oklahoma Small Business Regulatory Flexibility Act: There are no anticipated adverse effects on small business as provided by the Oklahoma Small Business Regulatory Flexibility Act.

H.An explanation of the measures the Agency has taken to minimize compliance costs and a determination whether there are less costly or non-regulatory methods or less intrusive methods for achieving the purpose of the proposed rule: There are no less costly or nonregulatory methods or less intrusive methods for complying with state mandates.

I.A determination of the effect of the proposed rule on the public health, safety, and environment and, if the proposed rule is designed to reduce significant risks to the public health, safety, and environment, an explanation of the nature of the risk and to what extent the proposed rule will reduce the risk: Implementation of the proposed rules will bring the rules into compliance with current practices and procedures, which will have a positive impact on the health, safety, and well-being of those served by OKDHS.

J.A determination of any detrimental effect on the public health, safety, and environment if the proposed rule is not implemented: If the proposed rules are not implemented, current practices and procedures will hindered by the lack of clear, consistent information; ultimately, affecting OKDHS strategic planning efforts.

SUBCHAPTER 39. PLANNING, RESEARCH, AND STATISTICS

 

340:2-39-1. Office of Planning, research Research, and statistics Statistics

(a) Purpose.The purpose of the Office of Planning, Research, and Statistics (OPRS) is to:

(1) promote the growth and development of strategic planning conducts data-driven research and statistical analysis of Oklahoma Department of Human Services (OKDHS) programs and services, including grant evaluation;¢ 1

(2) encourage and support data-driven decision making collaborates with OKDHS divisions to communicate and disseminate information regarding OKDHS research, programs, and services;

(3) provide technical support regarding research, statistical analysis, and grant proposals serves as the official clearinghouse for language translation, forms, and appendices for OKDHS;

(4) support optimization of federal, state, and other resources in support of the Oklahoma Department of Human Services (OKDHS) mission provides technical assistance in designing, developing, and implementing strategic planning for OKDHS; and

(5) assess whether policies and practices are attaining desired results or outcomes; and maintains program statistics and prepares policy-related analysis and a variety of complex state reports.

(6) assist in re-engineering policies and other forms of communications as needed to attain desired results or outcomes.

(b) Reports.OPRS prepares and files reports for the:

(1) Social Services Block Grant (SSBG), Title XX of the federal Social Security Act, which includes the:

(A) Report of Intended Expenditures for each federal fiscal year that is submitted to the U.S. Department of Health and Human Services (DHHS) on or before September 30 of each year, per Section 96.10 of Title 45 of the Code of Federal Regulations (45 CFR § 96.10);

(B) Report of Actual Expenditures for each federal fiscal year that is submitted to DHHS on or before March 31 of each year per 45 CFR § 96.74; and

(C) a notice of submittal for each report that is published on the OKDHS Internet on or before the respective submitted date;

(21) OKDHS Annual Report, required by Section 162(f) of Title 56 of the Oklahoma Statutes (56 O.S. § 162(f)), that is produced and submitted each year to the Governor on or before November 1; and

(32) OKDHS Strategic Plan, required by 62 O.S. § 45.3(A), that is produced and submitted every two years as described in OAC 340:1-1-18.
