SUMMARY:

The proposed amendments to Chapter 75 Subchapter 1 amend the rules to include foster parent notification rights.

The proposed amendments to Chapter 75 Subchapter 3 amend child protective services rules to:(1) delete redundant language and a reference to an internal committee no longer in operation; and (2) revise policy to permit charging a fee for a child abuse and neglect information system (CANIS) search on prospective guardianships for children not in Oklahoma Department of Human Services (DHS) custody, per Senate Bill (SB) 1135 (2018).

The proposed amendments to Chapter 75 Subchapter 6 amend child permanency planning rules to:(1) clarify permanency plan preferences; (2) revise policy on family team meeting; (3) update education guidance following passage of the federal Every Students Succeeds Act, Section 6312 of Title 20 of the United States Code (20 U.S.C. § 6312); and (4) move the medical services for a child section to a subchapter created for children's well-being.

The proposed amendments to Chapter 75 Subchapter 7 amend foster care rules to: (1) reference medical services for a child by the new administrative code number; (2) make changes to resource provider annual reviews; and (3) update military service personnel background information search requirements.

The proposed amendments to Chapter 75 Subchapter 8 amend therapeutic foster care rules to reference medical services for a child by the new administrative code number.

The proposed amendments to Chapter 75 Subchapter 11 amend community-based residential care rules to reference medical services for a child by the new administrative code number.

The proposed amendments to Chapter 75 Subchapter 12 revoke the subchapter on Oklahoma Department of Human Services (DHS)-operated group homes that DHS no longer operates.

The proposed amendment to Chapter 75 Subchapter 13 amends the rule to reference medical services for a child by the new administrative code number.

OAC 340:75-3-140 is amended to allow DHS to charge a search fee not to exceed $35.00 of CANIS records for an individual pursuing guardianship of a child not in DHS custody and other adult household members.

Part 4. Specialized Investigative Protocols, Child Death or Near-Death Reporting Protocols

OAC 340:75-3-410 is amended to correct a reference to trial-adoptive home investigation.

OAC 340:75-3-460 is amended to remove a reference to the obsolete Critical Incidents Review Committee.

OAC 340:75-3-530 is amended to clarify responsibility for notifying district attorney when an investigative finding is reversed upon appeal.

D.A description of the probable economic impact of the proposed rule upon the affected classes of persons or political subdivisions, including a listing of all fee changes and, whenever possible, a separate justification for each fee change:The proposed amendments do not have an economic impact on the affected entities.Section 2-101 of Title 30 of the Oklahoma Statutes was amended during the 2018 Legislative session to require DHS provide to the court before appointment of a guardian, a child abuse and neglect information system (CANIS) background search of a prospective guardian and all other household members 18 years of age and older.The Statute allows DHS to charge a fee not to exceed $35.00 for the search. There is a fee change associated with the revised rules in OAC 340:75-3-140 related to this Statute change; however, DHS does not plan to implement the fee unless providing CANIS background searches without charge becomes cost prohibitive.

E.The probable costs and benefits to the Agency and to any other agency of the implementation and enforcement of the proposed rule, the source of revenue to be used for implementation and enforcement of the proposed rule and any anticipated effect on state revenues, including a projected net loss or gain in such revenues if it can be projected by the Agency: DHS includes the cost of printing and distributing the rules, which is estimated to be less than $20. The proposed amendments will result in enhanced delivery of services to positively impact placement providers, families, and DHS staff.

F.A determination whether implementation of the proposed rule will have an impact on any political subdivisions or require their cooperation in implementing or enforcing the rule:The proposed amendments do not have an economic impact on any political subdivision, nor will the cooperation of any political subdivisions be required in implementation or enforcement of the rules.

I.A determination of the effect of the proposed rule on the public health, safety, and environment and, if the proposed rule is designed to reduce significant risks to the public health, safety, and environment, an explanation of the nature of the risk and to what extent the proposed rule will reduce the risk:Implementation of the proposed amendments clarifies and updates rules that facilitate quicker, more efficient service delivery to children and families and may reduce risks to children's health, safety, and environment.
