Frequently Asked Questions: Licensing Data
The reporting date is the date the OMMA shared this data. The reporting data typically shows licensing totals as of the last day of the previous month. Example: A reporting date of May 1, 2020 would include data totals from April 2020.
It is largely attributable to statutory and regulatory changes that took effect in November 2021, which removed a grace period for expired business licenses without a renewal in process. OMMA implemented those changes before that report. The reduction in commercial licenses can also be connected to an increase in the number of license surrenders OMMA received since the previous report.
OMMA does not have statutory authority to place a cap on licenses, or issue a moratorium (pause) on processing license applications.
OMMA is required by state law to inspect businesses once a year, and has been hiring more staff to meet that obligation. OMMA inspected about 25% of licensed businesses in 2020-21. OMMA’s goal is to inspect every licensed business at least once in 2022.

Frequently Asked Questions: Tax Data
The SQ 788 excise tax is for retail medical marijuana sales. It is 7% and is collected at the point of sale.
This varies by municipality and county. Voters in each municipality set their county and municipal sales taxes, which are charged in addition to state sales tax. OMMA does not receive sales tax revenue.
As of right now, the first $65 million collected in SQ 788 taxes for the year gets split between the State Public Common School Building Equalization Fund (59.23%), the OMMA (34.62%) and the Health Department (6.15%). This means the OMMA may receive up to around $22.5 million from SQ 788 tax revenue each year. The OMMA uses this revenue to fund our operations, materials, contracts, equipment and salaries. Any SQ 788 tax collected in excess of $65 million for the year goes to the General Revenue Fund of the State Treasury.
The apportionment was laid out in SB 229.
Sales tax revenue goes to those local/state governments. OMMA doesn't receive that money, but we prefer reporting the amounts to keep the public informed.
OMMA's budget includes revenue from the SQ 788 excise tax and licensing fees. Contract expenses include licensing software, a quality assurance laboratory and services from other state agencies.

OMMA's total revenue includes licensing fees and OMMA's authorized share of the SQ 788 excise tax. As the graph below indicates, OMMA's authorized revenue is typically more than the authorized budget. Of the $90 million in OMMA revenue the Legislature has appropriated to state programs since FY 2020, $67.5 million has gone to common education.
