Frequently Asked Questions: Licensing Data

The reporting date is the date the OMMA shared this data. The reporting data typically shows licensing totals as of the last day of the previous month. Example: A reporting date of May 1, 2020 would include data totals from April 2020.

There are about 1,600 fewer licensed businesses compared to December. This is largely attributable to statutory and regulatory changes that took effect in November which removed a grace period for expired business licenses without a renewal in process. We implemented those changes before this report. The reduction in commercial licenses can also be connected to an increase in the number of license surrenders we received since that last report.

At this time, the OMMA does not have the statutory authority to place a cap on licenses. Additionally, we do not have the authority to issue a moratorium (pause) on processing applications.

This varies by year. In 2020 and 2021, we have visited about 25% of licensed businesses. The OMMA has set an internal goal of inspecting every licensed business at least once by December 2022. To learn more about compliance inspections, visit our compliance information page.

We are currently working on obtaining this archived data. Once we have it, we will update the page to include 2018 and 2019 licensing information.

Frequently Asked Questions: Tax Data

As of right now, the first $65,000,000 collected in SQ 788 taxes for the year gets split between the State Public Common School Building Equalization Fund (59.23%), the OMMA (34.62%) and the Health Department (6.15%). This means the OMMA may receive up to around 22.5 million from SQ 788 tax revenue each year. The OMMA uses this revenue to fund our operations, materials, contracts, equipment, and salaries. Any SQ 788 tax collected in excess of $65,000,000 for the year goes to the General Revenue Fund of the State Treasury.

The sales tax revenue goes to those local/state governments. Even though we do not receive that money, we prefer reporting the amounts to the public so they are informed.

The apportionment was laid out in SB 229 (https://legiscan.com/OK/text/SB229/2021).

The SQ 788 tax is for retail medical marijuana sales. It is 7% and should be collected at the point of sale.

This is dependent upon which municipality the sale takes place.
