SUMMARY:OKDHS 2-1-1 is amended to comply with the Oklahoma Merit Rules of Employment, OAC 530:10-9-94. Time limits for entering on duty.

OKDHS:2-1-1. Intra-agency transfer

A permanent, classified employee may be transferred from one Oklahoma Department of Human Services (OKDHS) unit or division to another at the initiative of OKDHS or the employee in accordance with appropriate Merit Rules.An employee may request a an intra-agency lateral in-class, same Job Family Descriptor (JFD)/level to same JFD/level, or the same pay band to another JFD, or demotional transfer by submitting a memorandum or letter with a completed Form P-12 11PE012E, Personal Data Summary Sheet Application for Employment, to the local administrator of the potential receiving unit or division.The potential receiving unit or division has the option to accept or reject the employee's request to transfer to that unit.

(1) When a An employee has been approved for transfer, the units discuss and agree upon a release date is given 14 calendar days to report to the new position.The maximum time for release is 28 calendar days.The receiving unit or division may, grant the transferring employee additional time to report in the interest of OKDHS per Merit Rule OAC 530:10-9-94.

(2) A permanent, classified employee may be transferred laterally from a position in one job family descriptor (JFD) and level to a position in another JFD and level that has with the same pay band, if when the Human Resources Management Division (HRMD) certifies that the classified employee possesses the minimum qualifications in education, training, and experience for the receiving unit's JFD and level position.

(3) Upon a lateral transfer, excluding in-class transfer, same pay band to a different JFD, within OKDHS, the employee serves a six-month trial period, unless notified in writing by the appointing authority that the trial period is waived.

(4) A permanent classified employee transferring laterally from a JFD and level to the same JFD and level does not serve a trial period.

(4)(5) During the trial period, an employee may, due to unsatisfactory job performance, be returned to the position previously held or, to another position in the previous JFD and level, upon appointing authority notification from the appointing authority. of the reason for the action per OAC 340:2-1-28.
