Overpayments and Child Support Not Considered Income – Payments listed below are not considered income

  • Money withheld from income to repay an overpayment from the same source
  • Money voluntarily or involuntarily returned to repay a prior overpayment from the same source
  • Child Support received by TANF recipients that is sent to OCSS to maintain TANF eligibility

Money withheld or returned to repay overpayments for assistance programs are counted if it results from intentional program violations (established by the rules of that particular agency)

Examples of Intentional Program Violations:

  • SNAP – Willful misrepresentation
  • SSP for ABD programs and TANF – restitution, fraud, and willful misrepresentation
  • SSA / SSI and Veteran's Benefits Administration - fraud
