Intentional Program Violation or Fraud

An overpayment claim is considered intentional program violation or fraud if one of two things occurs:

  • A person intentionally gives false information or withholds facts in order to receive food benefits
  • A person trafficks benefits for cash or non-food items

An adult household member may receive an overpayment due to intentional program violation if they:

  • Made a false or misleading statement, or misrepresented, concealed, or withheld facts
  • Committed an act that constitutes a violation of the SNAP program, relative to the:
    • Use
    • Presentation
    • Transfer
    • Acquisition
    • Receipt
    • Possession of food benefits (e. g. having the possession of food benefits that aren't yours, etc)
