Ignition Interlock Device Requirements for Reinstatement After the Mandatory Period of Revocation
Authority:
47 O.S. Section 6-212.3
Upon becoming eligible for reinstatement following the expiration of the mandatory period of revocation for a DUI or APC conviction, or for refusing the state’s test or tests, or failing a state’s test or tests, State law may require the person to show proof of installation of an ignition interlock device as a condition of reinstatement.
The ignition interlock device shall be installed at the expense of the person after the mandatory period of revocation has ended for the following periods, as applicable:
- For a first revocation and if the person refused to submit to a test or tests, or had a blood or breath alcohol concentration of fifteen hundredths (0.15) or more, for a period of one and one-half (1 ½) years following the mandatory period of revocation or until the driving privileges of the person are reinstated, whichever is longer;
- For a second revocation, for a period of four (4) years following the mandatory period of revocation or until the driving privileges of the person are reinstated, whichever is longer; or
- For a third or subsequent revocation, for a period of five (5) years following the mandatory period of revocation or until the driving privileges of the person are reinstated, whichever is
longer.
When an ignition interlock device is installed, the ignition interlock provider will provide the person a certificate of installation to be given to DPS as proof of installation. Information concerning approved ignition interlock devices and approved providers can be obtained by calling (405)425-2142 or visiting the Board of Tests for Alcohol and Drug Influence’s (“BOT”) website at http://www.ok.gov/bot/Ignition_Interock/.
After the person has met all requirements of reinstatement as noted on the Order of Revocation, DPS will issue a restricted driver license that will indicate that the person is only authorized to operate a vehicle upon which an interlock has been installed. The wording “Ignition Interlock Device Required” will be placed on the driver license. DPS will also charge a restricted driver license fee in the amount of $50.00 in addition to all other required fees for reinstatement.
